Need help with an immigration question that so far no one has been able to give me a real answer to!!?


If a person is arrested but not convicted do they still have to wait 5 years to meet the "good moral character" requirements for naturalization? Does "good moral character" only apply to convictions or do arrests and dismissal count as grounds for denial as well? Anyone here who's a lawyer or studying law that could help me? thanks!

No, they do not have to wait. A not guilty verdict or a drop of the charges make that event/crime a non-event. It never happened. However if the person was in an illegal status they would still be deported and that usually starts the 5 year clock all over again.

Only convictions count in and of a criminal charge.

The moment you are arrested the reason and all details on the arrest goes into your permanent record even if you are not convicted.

...please, with all due respect... don't waste your time asking important question on "Yahoo"... call the U.S. Dept of Immigration and Naturalization Service and ask them... not the "gang" that hangs out on a place called "Yahoo"...go figure...

are you unable to understand the terms and conditions, stated in immigration regulations? If this is the case you should talk in person with the immigration service or an immigration attorney.

If it was dismissed with prejudice then forget about it; it's gone. If you are just waiting to be recharged...your timer is reset.
