If an illegal alien physically harms me can i sue the govt.for not enforcing immigration laws?

I've heard of it being done in a murder case where the alien had actually been arrested but released, however, I don't think the courts will support it.

Let's watch and see, though. One of the things that passed in Colorado on the 7th was a requirement that their attorney general sue the federal government for failure to enforce illegal immigration laws. They figure they are owed education costs, incarceration costs, etc. etc.

Also, Rox is right. In LA for example, Special Order 40 might give you a case.

You can't sue the government unless it gives you permission to sue it...that's the law.

I'd give it a try. What have you got to loose?

you can't sue the goverment.they can't catch every ilegal alien in this country.there's thousands.i think they do what they can about it.but still think they should raid every home that has like 20 living in it.im sure at least,15 out of 20 are ilegal.i understand that they come to this country looking for a better life for their families.but they should do it the right way.

No...that would be like suing the police dept. for not preventing someone from being robbed........

TO REPORT AN ILLEGAL ALIEN OR CRIMINAL ALIEN RESIDENT contact the Immigration and Customs Enforcement (ICE) division of the Department of Homeland Security by calling (866) DHS-2ICE to "report suspicious activity" (866) 347-2423.

You can also make a report with the DHS/ICE Investigations division in a city near you through the telephone numbers listed on the ICE web site鈥攆or Special Agent-in-Charge (SAC) Offices, and their subordinate field offices called Resident Agent-in-Charge (RAC) and Resident Agent Offices (RAOs). You can even write them a letter if you want to make a written record.

I don't think you can sue the Government but you might be able to sue your own State or the State in which the offence occurred. I have been watching news reports, and documentaries about how often illegal aliens are committing serious crimes against legitimate American residents and citizens. I think the whole situation is outrageous, but the power truly IS with the people and if those people who feel this outrage would only band together, the government would be forced to sit up and take notice. And what could possibly be a better time than right now, where so many politicians are looking to their careers as a Presidential Election looms in the not all that distant future.

Try it, have not heard of this being done yet. A few hundred people suing for billions might just get their attention.

I asked a somewhat of a similar question awhile back, got a lot of good answers. Someone did point out that in a sanctuary city you might have an actual case. I would also think that if the illegal alien had already been arrested and not deported then you might also have a case. I do believe there are several victims/ family members that could probably make several good cases.
If you are serious you should contact some lawyers to see if they would like to make history.
