When an act of congress is passed to reform another does it mean the first act is automatically repealed? |
Like for example if the Restoration of Fairness in Immigration Law Act is passed does it automatically repeal the Illegal Immigration Reform and Immigrant Responsibility Act (IIRIRA)? I don't get it because then they'll have 2 set of complicated laws. How do judges decide which to follow when these sort of things happen? No, the second act does not automatically repeal the first. All acts remain valid until overridden or repealed. Congress writes acts with knowledge of prior acts on the subject in mind. If there is a conflict, then the more recent law will prevail. |
