Could Social Security disregard the judges order regarding "No-Match Letters"?


What would be the consequences if the Social Security simply ignored this Judges order and sent these No-Match letters to employers anyway?
If someone is using your Social Security number, don't you want it stopped?
The pro Illegal immigration advocates never cease to defy common sense.

No-Match letters are still perfectly legal. It is the fines that are not - for the moment.

There is nothing to stop the SSA advising an employer of a failed match. Indeed, it is their duty to do so. That way, FICA contributions can be allocated to the correct taxpayer. The IRS is allowed to know about the no-match as well. That does not stop them from visiting employers with a large number of no-matches and "randomly" auditing their payroll records.

There is always more than one way to skin a cat.

EDIT: What's with the tumbs down for the other two posters? Construing the case narrowly, they are both correct. However, if the political will is there, the same effect can be achieved using a different approach.

The government cannot openly disregard a judge's orders. The last time that happened was in 1857, and it led to the Civil War. The only way to disregard a judge's order would be to scrap the Constitution and write a new one.
