What level of suspicion...?


does a Border Patrol agent need to stop an employee in a factory and ask for proof of citizenship or immigration status?

in other words, would they need reasonable suspicion? probable cause? or what type of suspision etc


I have a test soon...and im doing research on it...thanks

Technically I dont think that they NEED to have any level of suspicion as you are required to provide a BP/Immigrations/Customs etc officer with your proof of citizenship or immigration status when asked. However it is very unlikely that they are going to just randomly go around checking people for this. They would do it in response to some sort of complaint or belief that a company was employing illegal immigrants.

It's likely that someone turned in that particular company (the factory) as being one that hires illegal immigrants. It could be that the one turning in the factory felt s/he had a reasonable belief that it was true ... or it could have been a disgruntled employee or former employee.

That, alone, would be reason for investigation and that is part of the job of Border Patrol agents.
