A person legally entered the country with F-1, lost status and got married to a U.S. Citizen. Whats at stake?


The person has been married for almost 2 years now with a child. Attended school till final semester before graduation but couldn't complete due to financial reason. Been out of status since 2005. The spouse didn't make much money to sponsor and a co-sponsor is required. The joint sponsor is willing to help but would like to know if the the individual is even eligible for immigration benefits.

Since SEVIS is established, many of F-1 who no longer attended school were put on deportation list in one year. In your case, better check if you're on this list or not. If yes, get a good immigration lawyer and file for "removal"...

When deportation was removed, then you can proceed with I-485, etc.
