Does anyone knows what happens when you a arrested for a felony and the charges get reduced to a misdeormeanor


my boyfriend was arrested and was in jail for 3 months for a d felony charge, he paid his bail and was about to come out until immigration caught him and told them they were holding him in custody, now he went to court on tuesday and they told him the charges were reduced to a misdeormeanor charge. do u think he will still be incarcerated or deported. any advice or sites on reduces the charges will help. thanks.

Sorry to tell you, but deportation is inevitable. However, all it means when they drop the felony to a misdemeanor is a lessor crime, thus sentence (must have a felony to go to prison unless he was on parole). They might be making a lessor charge so that the state/county can give him time served and immigration will ship him back ASAP. Based on my experience, this seems to be the most logical given the information provided.

Good luck in your plight! My best advice is for you to realize that your boy friend may possibly never gain legal citizenship in the US (criminal background on US soil). You might have to reevaluate your relationship, cause unless you are willing to move to his country or wait for his illegal re-entry, you will be alone for some time. In addition, if he does illegally regain entry your lives will be an extremely tough road e.g. have a child with him and he gets caught and shipped away leaving you a single mother (one of many possibilities).

DEPORTED,AT LEAST I HOPE SO,ILLIGAL ALIEN,SHIP HIM/HER BACK !!!!!!!!!!!!!!

Whats the matter, you don't like American men. I hope they deport his *** or send him to prison where his *** will belong to the entire cellblock.

He may have to sit in Jail for the Misdemeanor charges. But he still will face deportation after his sentance is complete or he may get a suspended sentance and immediate deportation.
