A tort is a negligent or intentional civil wrong not arising out of a contract or statute. (B)

As for contracts you need to be more specific as to what type of contract. I see that you have indicated legal aspects of health care however, I would need to know what the contract is for to answer that portion of your question.

I would say it's B. The main element of a tort is negligence and most torts are derived from contracts.
