Please Help me family property matters? |
My Grand Fathers Property is there i dont have any documents but my Paternal Uncles have it and they are selling it my father expired 8 years ago now they are not considering me to give the share how can i fight for my right, i decided to go to the press if they dont agree i give it in newpapers help me to solve this problem. Problem with all you guys that firstly you never mention your religion, country you belong & exact place you live (city/State), next you don't give full details as in this case whether the Grand Father you talk is your paternal or maternal grand father? Whether the Grand Father still alive or dead? When the Grand Father died? Before your father or after him? What all I can make out here you is Muslim by religion as your name suggests & you are from India. Considering this your are covered by the Muslim Shariat Law & this being your Paternal Grand Father died leaving behind your Paternal Uncles & you the surviving son of the predeceased son. In this case considering your case is one covered under the Hanafi law, all of you are covered under the Class II Heir : (Ababat) wherein under the Group I covers all the sons , daughters of the deceased Grand Father & as far as Son's Son (i.e. you) become legal heir (only in absence of a son, in this case there are Paternal Uncles/Sons). All sons take equal shares in the property of the Grand Father, where Sons & a Son's son (i.e. you) co-exist (as in your case), the latter cannot inherit though you are the orphaned nephew of these sons of your Grand Father. Now this is the personal law concerning Muslims in India for which whether you go to press or other media or courts this will not change because the large population of Muslims in India don't want any changes in their personal law & they are not interested in a common civil law covering all such matters to be brought in by the Government of India although promised under Article 44 of the Constitution of India. Although my words/phrases are very hard for many Muslim fundamentalist to digest as they come out giving me thumbs down but they too cannot ignore this reality which I state in my answers here concerning Muslim Personal Law as provided in the Shariat. It's impossible to say whether you have any rights to the property or not as against your uncles without knowing what state you are in or whether your grandfather left a will or a trust to govern administration of his property after he passed. Absent a will, you have no right to the property. Contact a lawyer and get a copy of the will. You would have to contest the distribution in probate court.
