Can the police force someone to move out of a friends house if they aren't family? ?


If you are, say, renting a house and the neighbors have a problem with who is living there but the land lord hasn't said anything about it can the police force those individuals to move out of the house?

Most municipal codes have ordinances that deal with non-related persons living in the same dwelling unit. Technically it would be a violation of the Certificate of Occupancy and yes the police could enforce the law. A complaint would be filed and the offender removed by court order.

If they pay rent than even the landlord can't kick them out. The police can't kick them out. Even if they pay rent. Only the landlord can but he has to give them a formal 30 days notice to leave. Its the law and if kick them out illegally than they can sue you.

I think it will depend on your lease. If your lease is in both of your names they can't make that person move- probably just a citation for whatever (I'm guessing noise?) If you lease is just in your name they may have a little more grounds.

They will probably try to reason with them. If it is a civil matter, (like they paid the rent) then you might need to get an eviction order and the Sheriff can force them out.
