Is there more rebellion is this type of family?


In a foster family as apposed to a biological family?
If a large crime is commited by a minor is the child's guardian to be legally responsible?
Elaborate.

The guardian would not be "legally" responsible. Meaning that the guardian would not have to serve prison time. The juvenile may be required to pay restitution. If the juvenile failed to do so or refused it could fall upon the legal guardian to pay.

It would take an essay to do justice to this question.

I do think that it would be sensible, were a parent to be made legally responsible for the actions of their child until the child reaches the age of legal responsibility. However, the law would also have to accept that it had a duty to allow a parent reasonable freedom to discipline the child.

At the moment it seems that the state has removed the opportunity for a parent, school teacher, police officer, responsible citizen etc. to correct a youth in any way which has any impact on the behavior of the child at all!

As regards a foster parent, I think we are entering a completely different situation altogether. It is difficult to expect a temporary guardian to be legally responsible for the actions of a child when they are offering (for want of a much better word) respite to the child from any number of temporary situations.

I think it really all depends what crime was commited, was the foster parent negligent in the care they are supposed to provide ( IE.. like a 8 yr running the streets at 1 am without adult supervision and the foster parent not caring, looking, or contacting authorties to find said child) , and the age of the child in question.
