If my gf is in the mental hospital can her family have a restraining order on me?


My gf is 45 years old. She recently went to the mental hospital. Her family never liked me. Her father threatened to have a restraining order on me if I called her there to check up on her. Can they legally do this if she volunteered to go there? She wants to talk to me because I am her bf but her family keeps threatening me.

She turned herself in the hospital because she had a nervous breakdown at work. I am very supportive of her but I am afraid of her family.

If they can get the courts to declare her incompetent then her guardian would be able to do so. But it would take more than a 72 hour hold to do that.

Stay away! You don't need all that drama in your life. She obviously needs some help. I hope you're not responsible for abusing her. If so, you need some help too. Why else would you be worried about a restraining order? Get on with your life & learn from all this. It's important to have a good relationship with a girlfriend's parents or they can really make your life hell.

If your gf is mentally competent (not sure if this is true if she's in a mental ward) she alone can take out a restraining order. If I were you, I'd arrange to meet with her therapist to see what's best for her.

They have no legal action against you. Go see her if she wants you to.

It may be the hospital policy not to allow anyone but immediate family to visit her and anyone the family approves. It is possible for them to obtain a restraining order against you, however, the duration will likely only last through her stay in the hospital. Thereafter, it will depend on her mental state and whether the court finds it appropriate to appoint a guardian to handle her affairs. Unfortunately, it will likely be her mother or father that is appointed. Everything will totally depend on her diagnosis. If you think you will make the situation worse for her by calling or going to see her, don't go....wait until she gets her present issues resolved before adding more to her plate.

You have the right to see her if she wants you to see her. Also why does her family want a restraining order on you? Did you say something offensive about one of them?

technically i think only her doctor can decide whats best for her once she is in there .. i mean if they didnt think her seeing her family was a good idea they would do something about it. No, their family cannot have a restraining order placed on you. No adult can request a court order to restrict 2 other adults from seeing each other--thats not how it works.

And to address the previous answer, transferring power of attorney does not extend to the right to bring standing to a lawsuit on another's behalf.

A restraining order is a court injunction that refrains you from doing something, whether its from seeing someone, or maybe keeping your music turned down. They cannot sue him on her behalf.

Now to step out of legal-speak and back into reality, you should think if your girlfriend would be mad if you made her family mad, essentially forcing her to choose sides between you and her family during this stressful time for her.

Also be advised that her family can always call the cops on you for something completely bogus, or warn hospital staff not to admit you into the facility. So this situation might be out of your hands. Now if that's the case, you may have standing to sue. Not that you'd win, but you could at least make a legitimate threat.
