Grampa left mineral rights to our family; is my hubby entitled to any oil revenues? what about my will? |
This is a second marriage for both my husband and I. we both have children of our own. In the event of my death, do the mineral rights and revenues from any oil automatically go to my husband? Or do they stay in the (blood) family; i.e., my kids? Very vague. YOu would need a probate atty to review the will and see under what conditions what percentages pass and to whom. How the revenue stream goes forward also depends on how the current ownership is established and how your will is written. Again; the probate atty is the answer. This might not help. This touches on Probate, and it touches on Land Interests, and is a sub-category regarding mineral interests, often treated differently from surface rights. |
