Is this Legal?????????????


Ok so the other day my partner and I went to pay rent at our real-estate. After paying rent they told us that the owner of the house no longer want's to rent the house out through the real-estate or otherwise and plans to move his sister in.
anyways we recieved a letter (lst Monday)
and have 60 days to find a new house and move.
I no they are the owner but shouldn't they have to
give us more notice than that since they wont us to move...???
And also what happens if we cant get a new place buy then ??? Do we just get put on the streets???
Does the real-estate have to help us find a new place etc???

Plz help. The date we have to hand in the keys is coming quickly and we still have no-where to go yet...
Im freaking out .... any addvice would be much appretiated

It depends on your type of tenancy as to what notice you must be given. If you don't have a lease and are on a short-term tenancy, 60 days may be plenty of time, and no-one has to help find you another place. If you are still there after that time, the owner can take steps to have the police help to turf you onto the street (although that will take time).

Same thing happened to me once, except I got a 30 day notice to vacate because the owner sold the property and the new owner wanted to completely renovate so they could charge higher rent on a nicer space.
I had to move in with my sister for a month and a half, til I found something suitable.
Sorry, but they can do this, and you really have no choice but to move out.

This would be illegal if you are under a lease.

If you do not have a lease, there is nothing illegal about it. 60 days is plenty of time to find a new place. If you don't find a place by then I'm afraid that's your problem not theirs. If you can't find a place withing 60 days, then you didn't try hard enough.

I am not sure if it was 60 days i think its a 90 days warning.

First it depends which country you are in as laws vary from country to country.

Most askers say which country they are in, with the exception of Americans, so, I'll assume you are in America.

That in itself creates another problem as laws vary from state to state. I can guess which country you are in, but not which state!

The real essence of your rights will lay in the wording of the tenancy agreement or rental contract. Read it through carefully. It should set out in detail how much notice the landlord is required to give you.

You will then need to check, that the agreement complies with any law applicable to your state.

If in doubt see a lawyer, and do it quickly. It might well be the case, that the Landlord is entitled to throw you out on the street, but he may be required to obtain a court order first.

If you choose to see a lawyer, and I recommend that you do. Take the tenancy or rental agreement with you.
