Can anyone tell me what you need to do to claim something as abandoned property? |
While my husband & I were separated he bought a 31 foot camper and lived in it at a friends house. My husband passed away & since there was no will I went through the courts & was named administer of his estate. I had a friend that I could keep it @ her place for free. The person where the camper is said I could leave it where it is as long as I wanted to. My oldest son came home and needed a place to stay so I went to see about moving the camper for him. The camper has been moved and I have heard from other friends that the guy that moved it is claiming it as abandoned property. He told me in front of several people that I could leave it at his house as long as I needed for free. What can I do about it if anything? Thank you, thats exactly what I thought. It just so happens that 1 of those friends that heard the conversation is a lawyer. You should have a title to it. He couldn't claim it as abandoned unless he notified you by registered mail to remove it from his property. Then he would also have to file a police report. Write him a letter telling him you want it or you will call the police unless he surrenders it to you. Get a lawyer in involved .... something can only be claimed as abandoned if it has been left standing for a while and the owner is uncontactable or cannot be traced .... this is not the case in your situation .....if this guy has moved it without telling you then he has effectively stolen the camper .... if he has disposed of it he has also handled and profited from stolen goods .... get statements from those who witnessed your conversation ..... they will support your claim for a verbal agreement with the landlord...... |
