My grandmother is a life estate tenant how long do we have to gather her possessions after her death? |
Grandfather died in 1994, grandmother thought us kids would not want the place, she agreed without us knowing for it to be willed a friend of his, making her a life estate tenant of the farm. Can we overthrow this?? Is there any way around it?? How long do we have to gather her possessions after her death?? We are all mortified this happened.... The only will in question is grandfather's: assuming it was properly formed and valid, he left it to a friend, with a life tenancy given to grandmother. That tenancy automatically expired on the date of her death (probate not involved, as her estate has no ownership of the farm). Removal of her personal possessions must be done under direction of the executor of grandmother's estate, for accounting purposes, regardless of whether grandmother has a will that disposes of them. However, the new owner (friend of grandfather) will surely appreciate not dragging it out for months. You can always consult with an estate lawyer but your grandmother was free to will the land to whom ever she wanted to, not sure on what grounds you would seek to over turn the conveyance but you never know thus the reason for a lawyer call a attorney right away,preferably one who deals in probate wills.good luck. |
