Need legal advice - Mom's estate?


My mom died a few years ago and my brother and I went through the procedure and got the letter of administration.

We have been living together in the same house since our mom was alive along with my boyfriend. The title is still on her name.

I have been unhappy living with my brother for a long time. There is no mortgage on the house but it is not insured because he doesn't want to pay for it. I pay all the utility bills since he quit his first job and was fired from the last.

Since I am having a baby soon I want to provide the best possible life for my baby and make sure that he has positive influences. My brother has started selling drugs and I don't want to live with him anymore.

What can I do?

Can I buy his share of the property? He is unemployed and I know that he cannot buy from me.

I would really like to keep my mom's house but if there is no choice can I force him to sell?

He has also made threats of burning it down, what should I do?

I'm so frustrated

The title is still in our mom's name.

We have a joint Letter of Administration

make the baby the issue and tell him you will buy him out and give him cash or he can buy you out of just move out and force a sale, it's not good to be in such an environment with a newborn.

He might feel entitled to be there. I understand your situation but he is also your mothers son. He most likely feels like he has nowhere else to go if you kicked him out of that house. This is a very difficult situation. You can contact an attorney and he or she will discuss what is possible.

I understand your point of view but I also understand his anger which led him to say he will burn the house down. He doesnt want to be homeless.

Go back to the lawyer who handled the probate case for you. He or she may have some ideas about options open to you.

There are so many details in property law and in probate law that the advice of strangers online cannot accurately and completely address your situation. Consult your attorney.

You didn't mention who has title. If you jointly own it, there is a way to sell it, split the money and move on. If brother is not willing, a court can order it.
