Realtor Contract/Legal Question? |
I recently ended my contract with my agent on 8/21. I asked her for written proof that it had been cancelled. I recieved a MLS ammendment form I was told at that time that ammendment form was all that I needed. In the form, it is filled out where the mls listing was Withdrawn on 8/29. Since then, I listed my house on craigslist and local sales network for sale by owner. Since them I have had a contract to buy for sale by owner. I went to the closing attorney, he said that I needed something in writting where I cancelled my contract with the BROKER AND THE REAL ESTATE AGENT. I stated to the attorney that my contract was cancelled,prior to this sale. I didnt know why he needed all these forms PRIOR to cancellation of my contract with my agent. This attorney even wanted a copy of where had a purchase contract fall through based on an appraisal issue, I had released the earnest money. How did that have anything to do with a new closing when I cancelled my contract on 8/21 with the real estate and BROKER.I found out that he does closings for the broker that I ended my contract with. So I sought the advice of another attorney and he said that If i have the MLS ammendment where the property has been withdrawn, I need to get the broker to sign it. I spoke with the broker and she signed it. I sent her an email asking her if this states that my contract has been cancelled. The broker emailed me back an email stating that - this states that we (the broker) withdrew my listing on 8/29 . The broker stated tin the email that it meant that we (the broker) no longer have the listing or are advertising it on MLS. The first lawyer is in in bed with the broker..... lets face it when you live in a small town,,,,,,, Everyone is in business with everyone. Its a simple question and I didnt say that I was ASKING A LAWYER and didnt ask for a sarcastic remark, either. I am asking for OPINIONS on this matter. Once you cancel your business dealings with the broker, you are generally no longer bound by the previous contracts with him/her. You will need to see a lawyer to clarify it all. What everyone is saying and i am too go get a lawyer to show you what to do and help you get it straight.Sounds like a mess and there all mad including you so get some help and it will all be ok and all will be normal for you again Why aren't you asking your lawyer? My opinion is that your screed is unreadable, and not just because you seem to have something against using paragraph separators or writing in a logical fashion. |
