Do you think it's wrong to place a legal claim on my biological father's estate? |
He didn't marry my mother or pay child support but I have documents that prove he is my father and that I am his oldest child. My mother passed away 10 years ago. Absolutely. he owes you something in memory of your Mother. Good luck sweetie. It's not *wrong* to make a claim against your biological father's estate, in fact it's within your legal right to do so. However, if he never acknowledged you as his child during his lifetime, you should be prepared for a legal battle. Get yourself a good attorney, and be prepared to pay a substantial sum in legal fees [which if you prevail may be ordered paid out of your father's funds]. Everything depends on the circumstances. If there is a legit reason other than "I need $500 shoes" then possibly yes. However the split between your mother and father may have caused him not to have to pay child support. If your over the age of 18 you may have trouble getting child support money. The correct answer to this question relies completely on the situation. Your too vague for any sensible person to give you an answer. Are you saying your biological father died? If so.....Hey, if you are sure you have proof, I would say "Go for it!" You are every bit as much his child as any other children he had later....but get ready for a fight! Good luck! (Why don't you speak to a family law attorney and see what he/she says?
