Can you put a claim against an estate in Canada?


If you want to sue a person for damages but they have no money or assets but they are inheriting an estate, can you put a claim against the estate that they are going to receive?

No. You sue the person who owes you the money.

If you win your case and get a judgment, then you can garnish their income. If you expect them to have income from an inheritance then you'd file an order of garnishment with the executor of the estate.
