Former employer owes me money...what are my options to get this from them? |
I worked as an assistant for a real estate company and as soon I was hired in April 2007 they took taxes out of my paycheck, then in September they decided it would be easier to treat me as an independent contractor and to not take out any taxes but said they would write me a check for the amount they already took out (which totals $1200) and would have to me by January since they didn't have the money at the time. But when January, February, and March came, they still didn't have the money. When the real estate market finally got bad enough, they had to let me go in early April 2008 but of course they still haven't given me the money! I call and email them almost daily but still hear excuse after excuse. What can I do at this point?? This is illegal. You should notify the IRS immediately. Refile your 1040 using a 1040X and add those taxes to your tax return. You will get action right away. The Wage and Hour Board at the Labor Dept. will also help you. They both love to be notified of this type of fraud. If possible , go there every day and rag on them face to face and let them know you're taking them to the labor board. But keep in their face big time . Also speak up loud enough so other employees can hear you. Have fun and good luck. Not much. What they (and you) agreed to do was illegal and a tax fraud and neither any court nor the labor board will enforce it. |
