What happens if a will doesn't go to probate? Does it have to?

If a person dies that owned a home, car, other personal proerty, etc... and did indeed make a will, does it have to go through probate court?

What if any and all legacies/wishes written in the will were followed through but the actual will never went to probate?

Are there any penalties for someone appointed as the executor that did not send the will to probate court?

How soon must the will be sent to probate court?

Why does it have to go through probate? The court has to oversee the estate, but shouldn't that be an option and not something that is mandated?

I am particularly speaking of Massachusetts, and MA probate laws....

no will, it goes to probate
you have a will, you can avoid that mess
no penalities for having an the executor thats the idea
get the lawyer and follow the will and make sure its done.

Well, in in Michigan the will only goes to probate court if it is contested by someone. If you, as executor following the final will and testament and nobody contested it, you're fine.

If some one write a will it must be legally done, and only by law one can get what it is written for him or her
