Am i being illegally evicted?


I have lived in my rental home for a year now.I have a month to month lease but i sometimes paid weekly or bi-weekly.It was discussed and always paid and accepted cheerfully.In the first few months we dealt with owner as landlord but in july he turned his property over to a real estate lady,with a notice that all rent and contact for anything go through her.she was a great prop. mgr and never had a prob.A week ago there was ticket on the door for a unregistered car i owned on the prop in the landlords
name and a ticket for the state of the yard.Well i had permission to park it there it had been there from day one.the yard was not in disaray except for a small trash pile in alley that belonged to landlord I took photos and called my prop. mgr.She picked them up to fax to owner,inspected my yard and said it was fine and did not tell me to move car but i told her i would work on it.Fixed tire,put car for sale told prop. mgr what i did and she said good,ok and all that.

Four days later i come home to find what property i did have in the yard gone,Bike,lawnmower,pool,empty cooler.I also had a 3 day eviction notice on my door stating i had 3 days to pay the april bal. of 375.00 or vacate on the 8th of april.I have a reciept dated and signed by my prop mgr. of a 125.00 dollars paid bal due april 9th.And the way we have been doing it as long as i paid at least a week everything would be as normal.i have all reciepts to show my rent was accepted that way.And my first notice to move car was badly scribbled on it.(move car or it will be towed this week)And i did car sold that day.My neighbor said the owner took my stuff in a truck and put up the notice.I called my prop mgr and she knew nothing about it.Because they didnt tell anything about eviction,violations,or even get back to her after she faxed tickets to them.Prop mgr is sry and confirmed to me that 3 day eviction wording leaves him opem to evict me even if i pay money not yet owed. Help Please

Really those 3 day notices they get from Office Depot are not a legal eviction. You have to be served by the court to be evicted. So pay the balance and if they still want to evict you, they will have to go through the legal process. Which can take up to three months. I would also inquire as to where my personal property was. As you can press charges against anyone who steals your property. Personally it sounds like they just want you out. But you can make it as hard as possible for them. I would however be looking for a new place to live.

Pretty much all they have to do is give you 30 days notice since it is a month to month. (however if you have kids or pregnant, I think depending on the state.....you might have a little more than a month....but not much?)....Best to start looking, anyway.....You might just find something out there that you can do land contract on and start buying your own home. Personally, I think....it may make more sense especially if you are young and plan on staying in the area.

So, what are you really asking?

With a month to month lease you can legally be evicted after given proper notice. This is usually 3 days plus 30 days. I would try and get a 1 year lease.

Laws vary from state to state, but generally with a month-to-month rental agreement, you can be asked to move out for no reason at all if you are given 30 days notice.

If any part of your rent is late, you can be asked to move out with only 3 days notice.

If you don't move after the end of the notice, you can be evicted.
