Anyone know about about leaving your children out your will in scotland?


In short my Gran had two children,my father and her daughter. My father died. There are five grandchildren, 3 from one side (the daughter's side) two from my father. My aunt got my gran at 87 four years before her death and almost 10 years after her son's death to change her will. The will is left to my aunt the daughter and divided amongst her other grandchildren. There was no falling out. I know that you cannot in Scotland write your children out of your will as they are entitled to two ninth of movable estate, how does it work for the grandchildren off. It would not of been my gran's wishes had she been ten years younger, but I would be more interested in what is my inheritable right for my sister and i.

I dont know about the laws there, but I would respect her wishes. Do you really think she would want you fighting over things that mean nothing in the end?

You are right, children cannot be written out of wills as they have legal rights, along with spouses.
This means that your father is entitled to his share of the property. Following this, you and your sister are entitled to your father's share with an equal amount and your mother is entitled to the sum of the shares you and your sister receive.

Depends - was he married when he died and how many children? 2 children are entitled to 1/6 of the estate each, if he was married, or 1/4 if he was not married. Only spouse and children have an automatic right, but not grandchildren.
