Executor of the Estate?


My husband was the executer of his brother estate. My huband had file a couple of lawsuits after his brother death to some company that caused his death now my husband has passed. A couple of the company had settle now I have checks coming for my husband. As his wife am I entitled to cash these checks They are made out to the Executer of the Estate with my deaceased brother in law name on them.

With your husband's passing, you became the substitute "executor" of your brother-in-law's estate through your marriage, unless there was specific instructions in either will that excluded you from that role. I cannot tell you how the banks would handle a deposit of that type because the check is not made out to you. To some extent this is up to your bank.

There is a business called "Prepaid Legal" that will accept you as a client on a small monthly billing to a credit card. They are traded on the stock markets and operate in most U.S. states. You may want to sign up, then ask how to handle this matter. You will be speaking by phone to a real lawyer licensed in your state. A month later you can cancel without penalty.

You are probably going to receive a lot of answers to this-- my best advise-- contact a Lawyer who should and can handle this for you.

Sounds like you need to see a lawyer to figure that out.
