How valid is a life estate when witnessed, and attended by an attorney with the person in favor to the estate? |
What is life estate in the state of NY? As long as it is witnessed properly and there is no finding of coercion, then it will probably be held valid. I'm a little unclear by what you meant, but I think that should answer the question. I dont think its valid but you need to ask a lawyer. A life estate means you have given your property away, but you have preserved for yourself the right to live there until you die. If I understand what you're asking (and I'm not sure I do), there's nothing wrong with an atty drawing up a life estate grant for the person receiving the property or receiving the life estate. I found the first part of your question unclear, though. |
