Registering real estate property with POA in Karnataka?


Is it possible to register real estate property in Karnataka in absence by giving Power of Attorney to someone else?

Any immovable property can be conveyed/transferred by the registration of the sale deed which can take place by the registrar of properies/tehsildar of the district where such property is located in presence of the seller & buyer who have signed such sale deed & which is duly witnessed by competent witnesses of the said property or in presence of any authorized person who has registered power of attorney issued by either of them. The registrar or the tehsildar has powers to verify the contents of the sale deed, ask for the identity proof of the seller, buyer & witnesses or the person who is appearing as power of attorney for either the seller or buyer. The person who has power of attorney to appear & get the property registered should carry the original & registered power of attorney in his or her favor, failling which the registrar/tehsildar can refuse to register the said property. This is the general rule applicable for registration of immovable properties in India. As far getting any property registered by any person who is neither a seller nor buyer nor carrying any registered power of attorney issued in his or her favor by either the seller or the buyer will not be possible in any state of India including Karnataka.
