My real estate lady lied to me about some things dealing with the house. How can I report her? Expose her?


I was informed by the real estate lady that if anything was wrong with the house, we could rectify it after closing. She was working both ends of the deal, so she wanted the paper signed. So it turns out that the roof leaks and she's telling me that I should have found that out before I bought the house. She will not offer help and lied about taking care of things after closing. The leak is old and has been painted over. What can I do to report her or get some satisfaction and/or money for the roof?

report her to the states real estate commission. That is what they are for. They will take your complaint seriously. Realtors must be ethical in their dealings, or they will lose their license.

You should be able to find information on how to contact them on your states website. Look for a link such as, "department of real estate" and you should eventually find the right office to contact.

If a leak was hidden by painting over, and not disclosed, that is against the law. The previous owner should be accountable for the repairs. You may have to take them to court for the repairs, but you can name the real estate agency in the suit as well.

Have a contractor come in and look at the damage. He/she should be able to tell you if the leak was there previously, and if someone attempted to hide it. Have them put it in writting for you. As I said, it is against the law for homeowners to hide things like that.

It's called buyer beware. If you don't have it in writing you can't do anything.

Unfortunately, at this point, unless you got this all in writing, it's your word against hers! There are some real hard lessons to learn about buying a home, or anything! When promises are made like that, ALWAYS GET IT ON PAPER, AND HAVE IT SIGNED AND DATED BY THEM!!! If she is working in a real estate office under someone, you may want to try to go above her. But........I think you know who will win! Sorry that you are in such a sucky situation!!!

Start with the office of the Attorney General for your state. Most states have a department of Real Estate that licenses Agents. That is where you file the complaint.

Sellers are required by law to disclose "known" defects in the house they are selling. The fact that the damage was painted over indicates they knew of the defect. Get some estimates and take the sellers to court. Include the real estate lady in the action. She may deny everything, but the sellers may rat her out once they are in court. You may get to settle with her Errors and Omissions Insurance coverage.

Besides reporting her to the state real estate commision, in many states there are laws that problems need to be disclosed by the seller of the house. Since they painted over the place where the roof leaked, they obviously knew about it and should have disclosed it. In some states, the sale can be rescinded.
Google real estate seller disclosure along with your state to learn more. Chances are good that the sellers owe you some money.

And, frankly, if you don't see results, I'd go to the local news channels or newspaper.

Real Estate agents are State certified, so contact your State board & make an ethics complaint.
Does your state have FULL DISCLOSURE laws??? That means a home owner & a real estate agent MUST disclose EVERYTHING that is wrong with a home they are selling. From a leaky roof to ghosts in the silverware drawer. EVERYTHING that is known by the home owner & the real estate agent is SUPPOSE to be disclosed to a potential buyer.....

Didn't you have a lawyer representing you? Didn't you have someone appraise the house? Did you get an architect (NOT a contractor) to inspect for for possible structural problems? Did you get an exterminator to give you a signed statement against termites and other possible problems?

The only thing you can do is get in touch with the State Attorney General and possibly the State Real Estate Board or Commission and file a grievannce... and I would do it as soon as possible! You got screwed... look for other problems, too!
