Legal question about estate for wrongful deathof daughter? |
We settle out of court for my daughter's estate (Indiana) We were only awarded her funeral costs and layers fees($17000). We let them make payments to us in what they wanted it to offer. It has gone through the courts. Now we get a legal bill after everything for the lawyer trying to collect the money and put a process to collect on them for $860 and maybe more. since this is a seperate issue, can we take them to small claims to colect that. Would we have a chance to win? She was one month shy of 21. Yes we knew it was illegal but this bar was known for seving underage drinkers. According to the cop, she was the first to die. According to him, she should have never left the bar in such a state. Let alone a friend who was 28(girlfriend). She dropped the girl off and started home when she was directed. We just "settled". We are not mean people. But what they did was wrong. Please note, the bar had no insurance and the bartender No liscense. They got nothing else out of the deal. No jail time or anything. What they did was wrong too! it all depends on how your lawsuit was settled. the settlement should state who is responsible for legal & collection fees. if it says you are, then you do hve to pay them. sorry for the death of your daughter--but she knew it was illegal for her to be drinking at the age of 19, so i don't think you let anyone off easy, as we are all responsible for our own actions. |
