Damage & Loss to the Estate Trust? |
I want to file suit against the trustee that did damage to the trust estate. The trustee has already been replaced by the court. Do I file the suit with myself as the plaintiff or the trust as the plaintiff or both? When this starts can the defendent file a suit against me? File against the trustee. Unless you are the new trustee, you are not legally positioned to sue on behalf of the trust; the new trustee could choose to make them a plantiff, you can't. you cant do this yourself. you need an attorney to prove that he was negligent with his duties in comparison with the correct standard. can he sue you yes he can. |
