What happens when it comes to paying Death Duties if the estate of a deceased person who dies without leaving?


a valid Will, and whose estate is divided between two different European countries, Scotland and Spain? The Probate is being sought in the country of his Domicile, Spain, but, once obtained will have to be presented in the Courts of Scotland in order to reclaim the acceptance of the Spanish Domicile of the deceased! Meanwhile Spain will be claiming taxes due on the estate in their country!
Due to the complication of the Domicile, and the differing attitudes towards Laws in each European country,(which in my opinion, as a victim of this discrepancy, should be solved as soon as possible,) the estate has been divided into two parts, as it were, and I suppose both countries will make sure they claim their dues, meaning that taxes will have to be paid in both countries!? Does the European Union really work juridically, I ask?
I think the answer to this question could interest many residents abroad who have experienced a simular peculiar situation.

The two countries have no bearing on the issue. The will would go to probate in the country that the deceased was living at the time of his death. All taxes will be payable in that same country.
The executors of the will deal with all of these matters, and pay any taxes due.
If this is a factual case, you may need legal representation, to help with any inheritance taxes that may due.

Try to imagine each of the two coutries as a greedy relative.They will not want to "give up"anything that they think they are entitled to.Our own Australian government is exactly the same,as is the English government,and any others for that matter.Having said that, there are systems, legally , financially etc, etc, that are in force in each country and it is every one's responsibility , if it is possible , to play them like a vicious game of chess.find the loop holes and you will win

a good lawyer will solve ur problem.
