What is a statement of claim regarding a deceased estate?


I am the trustee of a will relating to a family estate and one of the beneficiaries is filing a statement of claim in the Supreme Court. Can anyone advise of the implications of this action?

Laws relating to the administration of deceased estate differ in each state. As you mentioned the terms "statement of claim" and "Supreme Court", it seems there's a good chance you're talking about Qld, Australia.

In Qld, there are generally two ways you can start civil legal proceedings against someone - by claim or application. Most "normal" law suits are started by claim - when this is lodged in the court, it is accompanied by a "statement of claim". This is where the person sets out all the material facts which they say support their claim for damages (or whatever they are claiming for).

If you are the person to which this claim is directed, you will need to file a notice of intention to defend and a defence, perhaps with a counterclaim - get legal advice once you receive the claim.

I can only imagine they are saying either that you aren't administering the will properly or possibly there's some irregularity in the will (or that they should be entitled to more than the will leaves them - although this should be started by application not claim).

Without knowing what they are alleging, it's impossible to advise you of the implications of this, other than to say that you should cover yourself by double-checking you have done everything you should have. Gather together all your documents which can prove everything you've done.

It might help to see a solicitor to have them go over your documents and check that what you are doing / have done is fine.

If you have improperly distributed funds/property, in the worst case, you may have to put this money back yourself. However, if it is something like you haven't administered properly, you may simply be removed (although, again, this should be started by application, not claim, so it's hard to see what they might be alleging by claim).
