In California, Proposition 65 was a ballot initiative that was passed by the people in 1986 because state agencies were then considered ineffective in holding polluters accountable for cancer-causing contamination or for other pollution that caused birth defects. The unusual feature of Proposition 65 is that it allows private citizens to be enforcers of the law and sue violators for civil penalties if the state attorney general, a district attorney or full-time city attorney does not sue first within 60 days of a person's notice of violations to a business that is a polluter. This means that victims do not have to wait until contamination actually damages them to sue, giving Proposition 65 private enforcers the power to prevent harm by forcing polluters to reduce or eliminate dangerous pollutants before people are injured or killed. In 2003, the state legislature added protections for businesses from frivolous lawsuits by requiring expert consultations on the dangers of an alleged pollutant before anyone issues a notice of violations to a business for contamination.
