What Can I Do About My Ex Roommate's Furniture?


Recently my roommate moved out. He owes me in fact almost $1000.00 in rent and money that I lent him. Me and him had an agreement that he would leave his television (52" DLP TV) and a nice entertainment center behind until he paid me the money he owed me. He recently contacted me saying that he had $400.00 and that he wanted hs stuff back. I stated to him that I wasnt going to take that amount and wanted the rest of the money at the same time. Well needless to say arguing pursued afterwards and so forth. To be honest, I am not even sure I want the money anymore. The television and entertainment center is valued at more then what he owes me. Also, we have no written aggreements on anything (as in rent agreements or anything purtaining to the items). What should I do? I live in Louisiana. I am not to quite sure about the laws but like I said I am lost and trying to figure out what to do. I would actually like to keep the items. If he wanted to, he could take you to small claims court to get his furniture back OR money for the furniture and tv. You indicated you loaned him some money and he was supposed to pay for rent, but you have nothing in writing. So, you would lose, UNLESS he indicated he was supposed to pay for rent and you loaned him the money.

To be on the safe side, I would tell him to come pick up his items.

Lastly, it was a stupid idea to not accept the money he wanted to give you. That would look VERY bad in court for you and for you not having anything in writing.

Plus, he may be able to do a police report, but depending on the police, they may inform him that it is a civil matter.

You can't keep the furniture if he comes up with the $1000.

What does the contract you both signed state as to terms?
