Uk Legal Question Regarding Working As An Agent Please!?


I currently operate a mobile disco and wish to act as an agent for another party to cover me when I am already committed on a show.

I would be taking a small percentage of thetotal cost as a finders fee.

What are the legal ramifications of this?
Specifically:
If the client pays me the booking fee and then gives the 3rd party his cut on the night who is liable if:
a) he dosnt show
b) he sets fire to the place
c) a member of the public gets hurt
d) his kit gets stolen or damaged
I intend to get the 3rd party to sign something saying that we will not be liable to any claims whilst he is working on a booking provided by us and that the contract will be between him and the client.
I also intend to send a confirmation to the client stating that the entertainment will be provided by a third partyand that we are not liable for any of the things I mentioned as the contract is then between them and the third party

Will this do? Is there any other advice anyone can offer me?

Both of your suggestions are good for starters.

I suggest requiring your client/contractor to secure liability insurance and to name you as an additional insured on the policy so that his/her insurance will protect you in any matter arising out of work performed by him/her as your client/contractor.

If able to get him/her and the carrier to do it, that insurance should name you as a "named insured" and not as an "additional insured". It should also provide coverage on a primary and non-contributory basis so the carrier does not try to involve you or your own insurance (if you have any) instead of handling under its own policy.

The cost of that policy should be borne by your contractor but the contract between you and the contractor should permit you to secure such insurance yourself in the event he/she fails to do so and you could bill the contractor for the cost. If the contractor fails to pay you the cost, the contract should permit you to hold back the premium costs from any payments you would make to him or her.

You may have to haggle to get all the terms mentioned and your business may not be profitable enough to afford such coverage.
