Can she legally do this? |
I moved into an apartment with my best friend in July. She had been in this apartment with 2 other girls and they moved home to Chicago in May for summer break. Legally, it belongs to your roommate. It was given as a gift. If you have more than one person hearing her say this...preferably a 3rd party, I don't think she can take it. But you are right...there IS a verbal contract. If she wanted it, she should have taken it when she had a chance. Yeah. Or, tell her she can have it for $100 or some crap. He said she said. you keep it and let her bring it to small claims court. The judge will have to decide who has rightful ownership to the property in question. Laws may differ from state to state so talk to an atty in your area, s/he will know much more than anyone on YA. Good Luck!! If it were me, and she took my belongings, I'd quickly sell the dad-gum entertainment center and pocket what she owes for her clean sweep of my stuff. Then I'd tell her that she is crazy if she thinks there is an entertainment center to pick up because it doesn't exist in the apartment. Ha-ha! If I were you, I wouldn't even let her in the apartment. If she comes in without your permission, you can charge her with trespassing. However, if your roommate gives her permission, there really isn't much you can do and if she allows her to take the entertainment center, that's it. There isn't much you can say about that. Just tell your roommate that under no circumstances do you want her there without you present because she is a thief. Well you basically have wait around and make sure your friend doesn't let her take it when she lets her in the apartment. You are not required to be someone else's storage facility. At the same time it is her tv stand and if your roommate lets her in then and your not around then yes she can take it. If you are at the apartment when she tries to take it don't say anything, go into another rooom and call the police and let them know that someone is trying to steal some of your furniture. |

If they have a: Warrant Signed complaint - or Probable cause they can enter your home. If they come to your door, and one of those factors is present, they will enter by any means necessary... Contact a lawyer and ask him to write a letter demanding that you be removed. It should be inexpensive. ...I can understand BET...kinda. But only if they block MTV and the related channels also...I don't see the reason behind blocking CW though. ...Although on the face there seems to be a free speech (1st amendment) issue it relates more the the policies and rules of the educational institution.
