Felony State of Texas will not honor ?


This is not nessasaily something I want to tell a bunch of people I don't know about but I am thinking maybe someone out there would have a answer to my question....

So a little story my husband left Texas may of 2004 6 weeks after leaving texas they put a warrant out for his arrest. It is a felony warrant. Many times we have sat in our living room watching TV to have state troopers show up drag him out the door. They take him down to the station call Texas and texas say we don't want him...

Now my husband knows about the acurrance of the warrant since it happen at his place of employment at the time... However no one ever told him not to leave Texas and when he left Texas it was not something he did to run from the warrant (another whole story I won't get into).. Even at that this warrant never came out til 6 weeks after he left Texas (by the way he is innocent of this charge) My belief is they needed to solve a case and my husband was easy since he was not there. But still this is a felony and they will not extrodit him....

Also they will not return out calls or anything like that. Now we have run into a situation where we need to prove then they do not want him dispite of the warrant however they will not talk to us and tell us either way all we need is a statement from them saying they do not want us and we get no responce.

Does anyone has any idea how we would get them to respond????

Steve you are right about one this the state trooper will not come back, but the sheriff will, and so will the police until they hear the same story. Also everytime we move we are underdifferent jurisdictions. So yes you are right they will not return more then one time however there are circumstances in our life that puts us in touch from time to time....

Example he has epalepsy one day out on a walk he has a siezure and got comfuse (very common with his condition) walked into someones house. The people thought he was drunk and called the police. They sent him home but not before talking to Texas. Other then the warrant in fact they was wonderful here.... However everything is alot to explain at yahoo answers....

Something is wrong with your story. The state you were in would not come to your home unless Texas was ACTIVELY pursuing the warrant. Even if they did, after the FIRST time Texas failed to request extradition, they would not WASTE resources again. Even allowing for incompetence on the part of law enforcement, your story simply fails the laugh test.

Get a lawyer- and get them to work for you. You need to clear this up, and not have it hanging over his head.
Keep trying to contact them, if they aren't responding, maybe it is low priority.
A lawyer costs money- but it may be a good idea.

If you cannot afford an attorney to get this straightened out for you, you will need to call the courts and see if you qualify for one to be appointed for you in this case. Though you are supposed to be fully informed of any charges pending against you, this does not seem to be the case and this keeps dragging on, interfering with your lives. So, unfortunately, an attorney is the only way your are going to get anywhere. You might even call around to some attorneys for a consultation (most initial consultations are free) to see if any of them might give you some pointers so you can go from there. There are some good attorneys out there that will do this for you. I really hope you get started on this soon so you can get this behind you and don't have to worry about it anymore. A lot of this depends on the court that issued the warrant. I work for a sheriffs department in Texas and most of the times on a felony warrant issued by a district court they will fully extradite, also on violent of high class felony warrants issued by the county and justice of the peace courts they will fully extradite.

To take care of the warrant, find out what court it was issued through and contact their clerk. So for example if the warrant was issued out of Dallas, you would contact the Dallas County Clerks office.

If you've already tried that route try contacting the police agency that the offense occurred through. Again if the offense occurred in Dallas contact the Dallas County Sheriffs dept, or the Dallas Police Department and ask for the Criminal Investigations Division.

You should have the offense date, Your husband may also need his date of birth, location of the offense and his social security number.

If neither of these places help he could try going to the local jail where you are now and he can turn himself in. If Texas will not extradite there is no reason the local jail will book him and charge him for the crime. He will have to go back to Texas and take care of it.

If there is still an active warrant they do want him, so they will not issue a statement saying that they don't want him. If he were to go to the local jail they can get documentation that Texas will not extradite. Whether or not they can give that information to you is up to their policies. You could try calling your local police agency and talk to an officer about the situation.
