What are background check agencies in CA allowed to ask my previous employers for verification of employment?? |
Basically, this agency is harassing my former boss, they keep asking for more documents, paystubs, 1099 forms, W-2's...now someone told me that they aren't even allowed to ask for such documents in the state of California....is that true?!?! He sent them everything they need and they keep asking for more information!!! I really need this job, but what is their problem!!! What are these companies REALLY allowed to ask for, I thought it was ONLY verbal verification in the state of California anyways... The California Fair Credit Reporting Act does not specifically limit the amount of information an employer is allowed to disseminate. It is up to the employer to decide what information they will give to a background screening company. The background screening company is just attempting to gain as much information as they can for their client. If your old employer just tells them that As per our company policy, we do not disclose any further information, it will likely be completed. if you signed a documents that says they can do a background check on you, they might be able to. the only thing your PREVIOUS employer is allowed to disclose is how long you worked there and whether or not they would hire you back If you signed that they could check you out, anything. |
