Employment law help?


My aunt recently had an operation and had to have some time off work as she recovered. Her employer has given her a warning for having time off... what can she do? Is that actually allowed? I don't know anything about employment law

As Amber says, with a valid sick note, no it is not fair, and would be treated as discrimination/ constructive dismissal by any tribunal that she might take them to. She might wish to seek advice now, and get it sorted with the boss now, but personally, I would let them give themselves enough rope to hang themselves. Document all they do, ask for everything in writing, and in the event anything further happens, take them to tribunal and claim compensation.

Your employer dismisses you for taking time off If you are an employee, your employer cannot dismiss you for taking time off work unless they have first gone through a standard dismissal and disciplinary procedure (you are unlikely to be an employee if you are a subcontractor, freelancer or casual worker). If you are in this situation, you should talk to an experienced adviser straight away (see below). The adviser may be able to persuade your employer to take you back. If this doesn't work, you may be able to complain to an employment tribunal. If you are dismissed while on maternity leave you may be able to make a claim to an employment tribunal for both unfair dismissal and sex discrimination (but you may need to raise a written grievance with your employer first). There are strict time limits for complaining to an employment tribunal, and you should check that these do not run out before you make your complaint. did your aunt put in a sick note after being off work 3 days.
then after the first wee did she get a sick note from her doctor.
if she did then they can not give her a warning for being off work.
but if she has not put in a sick note then she is absent from work and they have every right to warn her

If she has a sick note then her employer shouldnt have given her a warning
