What is my legal right regarding this employment situation?


I requested the Friday 8/29 off work as a personal day (I have 5 days left.) My manager declined the days off explaining that he did not have the coverage for me to take a Friday or Monday off and that I should request Tuesday through Thursday off.

I have taken a Friday off previously in the year as well as he has taken a Friday off.

Are my personal days mine to take off when I want to as long as I give a notice (in this case 30 days)?

Can my manager prevent me from taking these days off especially when he has taken a Friday off?

What are my rights?

Any HR manual I've ever seen says that the granting of personal and vacation days are always subject to the approval of management based on the company's need for coverage.

YOu have the right to complain to HR. The company has the right to staff it's office as needed to stay in business and service it's customer. YOur boss has the right to have the staffing he deems needed.

I agree with the other answerers. Your manager has to make sure the job still gets done. The good thing in this is that your postion is obviously important. If it wasnt then they would have no problem letting you take a day off. Also different times of the year are sometimes busier than others and require all the staff on board. The best thing to do is to talk with your manager and plan with the company in mind, about which friday or monday would fit best.

"At will" employment means just that. You are at the mercy of your employer. He can ask you to work whatever days and hours he wants. He can tell you when to take vacation and personal days.

You can say no.
You can quit.
You can find another job.

You can take whatever days off you want.
Your manager also has the right to fire you.
You have the right to look for a job where you can take off whenever you please. Good luck with that. It is possible. It's called being self-employed.

A manager still has to approve the days off that you want. sorry, your manager has his right to say no. If he does not have anyone to take over for you while you are gone.
