Ok, can anyone answer this question?


Will I get the training pay?

Contract job let me go during paid training of 3 days for not being smart as monkey.

Position: SalesRep. Trained with two managers

My training as it were was about something I had no experience in. I don鈥檛 mean the product I would have been selling rather the Sales Pitch it's self, and this company knew that.

As a result of being trained with two branch managers expected to open branch offices in new markets in the south; their experience combined was that of my age 39.

My expenses totaled to $400; my contract stated a pay of $500 for training FOR ONE WEEK. Can I assume I will not be paid and if so do I have recourse?
When I signed the contract I used print in all capital letters then was Urgently told to sign in front of assistant mgr. Like a gun to my head for the purpose of employment. note I included UCC1207 means WITHOUT PREJUDICE after printed name in small font before forced to Signing.

but would it go by where the hireing takes place or where the training took place?

All i can say is i was never lead to believe i would have to learn this sales pitch with in a week. Rather be very close within 30 days by my goal.
Yet, i was not only expected to know the pitch, but also know the whole job Contracts, an all to pass the training and the person i was scheuled to learn by, had to be out for a death in the family. I am sorry for him but it happens.

I feel after i did what i was told to do contact the asstistant Manager back and he said to me "if you can't pass the training you'll never make it on the road".

Keep in mind this job was worth $60,000 + based on the company hand book and $75,000 according to the branch office. i didn't get bu 8 hours sleep trying to nail this position.

As it stands, your inclusion of the UCC 1207 specifically advised the agency you wanted to be employed, with the notation that you will not be forced to abide with the training procedures found not acceptable to you. In addition, any practice you deem not in agreement with your beliefs in the selling of the products will not be adhered to, to effect a sale. Since you obviously do not want to be a sales representative in the likeness of the company (a company man) the company has the right as an employer not to make payment not earned by wages or sales commission. As for recourse, the court will have to decide as to the theory why you used UCC 1207 which essentially makes you the sole individual responsible for your actions.

Sales is all down to performance. If you are a closer then they will not bat an eyelid at paying you $5,000 expenses for a week. If you can't close they need to get rid of you.

contact your stste labor board, set up an appointment
to see them.
take ALL your papers from your job application etc I mean everything, a forgotten paper looks very bad, take all with you to your labor board appointment,
