I got a updated employment contract n it says i have 2 do overtime or get disiplinary action.do i have 2 sign?


my updadted contract says i have to do overtime or i get diciplinary action. i dont want to do it all the time as i have a life!!!. do i accept this and sign the contract or not sign it as i dont agree witch that part of it?????
help!!!!

Obviously to give you proper advice on something as serious as this you should go see your employee rep, your union, the CAB or a solicitor.

The basic point is that an employer cannot unilaterally change the contract - if he did you could leave and make a constructive dismissal claim. Similarly if this is a new contract for a new job you have technically been made redundant and may have an unfair dismissal claim.

However your (current) contract may contain clauses which allow certain flexibility. There are also many "implied terms" in a contract which mean that as an employee you are expected to reasonably comply with your employers instruction. If for instance they had a big order in and needed people to do overtime for a temporary period it would be fair for you to comply.

All of these rules however are very much based on the specific facts of each case which is why the only good advice for you in this situation is to speak to your employee rep or someone else who can give you proper legal advice.

How much overtime are they asking you to do? I work in the care industry and wherever I work I have to sign a form that says I am prepared to work more than 48 hours a week, in agreement with EC Directives. Is your situation similar?

don't sign
i have that in my contract and on average i work 20 hrs a week over time and don't get paid for the work. i take home less than min wage. because my salary is just above min wage they can get away with it

It's either/or, pal. You agree to all of it, or you find another job.
