I am on salary as a manager, and my supervisor says I can not go out of town at anytime unless I ask her first. If she has plans then I can't do anything. I can't even take my kids to the beach for the day. They want me to be on call 24/7 with no additional pay. I must have my cell phone on at all times, if someone calls and I don't answer I will be written up No. If an employer places a travel restriction on an employee, that time is considered as work and needs to be paid. I've heard of having vacation days need approval before you can go (like requesting the time off), but if it's on a day you normally wouldn't work anyway and are not "on call" then I don't think your boss has the right to limit your travel. What if you or a family member fell ill and the nearest hospital was over 30 miles away? Would she expect you to call and hope that she lets you go before you take care of your medical emergency? It depends on the labor laws where you live, but in general, unless you have a contract stating exactly what you do and don't do, or are in a union, they can ask that you do anything (sexual harassment issues aside). You have the option of doing what they ask or not doing it. They have the option of allowing you to continue working for them or not. she can't do that! you should check the labor laws in your area. then I think there is a number you can call to talk to a gov rep and ask any questions you have. then you should tell your boss that that certain work related laws allow you to do what you want. If she fires you, you can charge the company with wrongful dismissal. when you took the job did you agree to be on-call all the time? are you paid enough to compensate for the imprisonment?.what is the job worth to you? don't ask to go out of town,simply inform i won't be available for the weekend ,im gone to the beach or whatever,go and leave the cell at home,then let it fall where it will ,put your foot down,don't be a whoosy ,it only gets worse....................tom Get a witness or two and go have a meeting. You can find out for sure by going over her head, though. You on a pager/cell? Have it go "bad." If it's in your contract maybe, if not then go ahead. Your employer is telling you you are on 24 hour call....Rediculous.. You better be getting paid 200,000 plus a year then..... Never heard of that one :/ i think NOT ! |
