My gf was the victim of armed robbery at her job in the parking lot. Do we have grounds to sue her employer?


Her place of employment is a national restaurant chain. We live in tx. I'm thinking we have grounds to sue based on emotional trauma, lost wages, unsafe work environment, and possibly more. Anyone have any knowledge of this? Also, if we do have grounds to sue, what type of settlement could we possibly be expecting? Restaurants usually have several million dollars of liability insurance per store.

In order to sue - you have to prove negligence. The restaurant did not rob your girlfriend.

You can sue the person who committed the crime.

I'm sorry your girlfriend went through that .....but stop being greedy.

You have no case against the restaurant.

Just be happy someone was looking out for your girlfriend and she's not dead.

If the manager of the store robbed her, then you have a claim against the company. Otherwise, your complaint is against the robber. The restaurant is not a guarantor of safety. To prevail, you would have to prove that the restaurant undertook to keep her safe, that they were negligent in carrying out that duty, and that if they had not been negligent she would not have been harmed. Good luck with that.

I doubt that you do, or should, have grounds for a lawsuit. Businesses are not obligated to hire security guards for their parking lots. Your suit would be frivolous and I would hope that you would lose and have to pay the restaurant's court costs for wasting their time and money.

Check to see if there were any previous reported crimes like that and then there would be grounds if there were enough to validate a security measure.

Man, the first thing everybody thinks of today is to sue, sue, sue sue,!!!! Did you even file a police report???

First of all does the restaurant own the property or do they rent it? Because if it is rented, they that involved the land owner and you might not be able to go after the restaurant because it did not happen inside the building. However, if it is a national restaurant chain then they have good lawyers, so I don't know if it would be worth it to find a better one because it is not the restaurants fault she got robbed and their good lawyers will prove that. Possibly unsafe working environment but even that is bit of a stretch because usually that pertains more to inside the establishment and like things such as co-workers and them creating an unsafe environment.

Businesses have all types of codes and insurance stated in the contract of employment and there is quite possibly a clause in there addressing robberies because that is quite common.

I suggest calling lawyers and getting opinions, but if it just happened on the property and the land is not owned by the restaurant, you may be SOL and you'll just be spinning your wheels.
