Will a juvenile misdemeanor in Florida from 10 yrs ago show up on an employment background check?


I will also have to be bonded, so I imagine the background check will be very complete. I had an FBI background check almost 3 years ago, and the charge showed up (despite being told that it would be expunged upon completion of community service program).

I'm very concerned, I've already been hired and am considering telling my employer in advance. Given the trust-based nature of this position, I am afraid that this will negatively affect their decision (understandably so).

Will it show up, and if so what are the chances of this affecting my employment status? It was a juvenile misdemeanor shoplifting charge, almost 11 years ago, and it is currently in the process of being expunged.

What should I do??

I would say it depends on what type of position you are applying for and for what sector. Generally, private sector employers will never garner the same information that the FBI will get when conducting a background check. If it is a position in the private sector, you should be covered by the Fair Credit Reporting Act. This law can be usurped by a government position, but generally not a position in the private sector.

No juvenile records are usually not public record however Florida is a very information friendly state. I'm not surprised that it would show up on the FBI check they keep track of all of that but it can't be used against you in an employment background check. Hey. I had A LOT of legal drama when I was in high school, and now I am 25 years old and work at Wal-Mart. They do back ground checks and drug tests, so they know who they are hiring. Apparently, my misdemeanors didn't show up anywhere. Thank God! Good luck, sweety!
