Background check for pre employment?


The company i applied for asked for misdemeanors or felonies in the past seven years, in the job application. They have told me the job is mine if I can clear the background check. I have an INFRACTION (much smaller than a misdemeaanor) of "theft of property" which is almost 7 1/2 years old. Would this still affect me? Ive lost opportunities in the past over this (but it was only 2-4 years old those times) do you think a jewelry store will hire me, given that its not a misdemeanor or felony and is past 7 years? Would that be illegal? Im CA, she told me not worry, but im just not sure.......

since its an INFRACTION i am unable to expunge it. Ive tried but the court said it must be a misdemanor or greater. ITS TOO SMALL TO REMOVE. but yet, big enough to come back....Ive tried.

All you can do is let them run the check. If I was hiring you, I would give you a break on it since it was 7 years ago. But, it's entirely up to them if they want to take a chance.

Have you ever looked into getting this record expunged? If it was your first offense you should be able to. Your lawyer just files a motion to have it expunged with the court, you pay a small fee, like $100, and it comes off your record.

I think the calender is on your side. However, this gave you something to think about didn't it???

If it was over 7 years you can truthfully answer no to the question.

And, no I do not think a jewelry store will hire you if it had anything to do with theft.

If you have a conviction it's either a misdemeanor or a felony. Those are the two categories. There is nothing "less serious"

I would always error on the side of caution by giving them to much information then not enough. I know as an hr person, I am more likely to give someone the benefit of the doubt if they are honest.

I think it shouldn't be a problem.
