Employment rights - help please? |
I have worked for a company for 1 year, if you have a full time contract then any reduction in hours must be put to you in writing. they cannot just reduce them , nor make any amendments without informing in writing. If you have a contract for a specific period of time, (like one year) then you (and the company) can enforce it. If it has no specific time frame, then both you and the company are free to terminate it at any time. When someone offers you a part-time job, they are in essence terminating the old contract and offering a new one. Employment contracts for an indefinite period are subject to renegotiation every day. Just as you can demand a raise in pay and promise to quit without such a raise, the company can make its demands and you are free to accept (by staying) or reject (by leaving) or your can counter-offer. if your written contract states how many hours you must work eg 40 per week this is your agreement between you & company, so if you did not turn up for 40 hpw you would be sacked through breach of contract, so if the company cannot supply 40 hpw you have the right to redundacy or you could walk out on a constuctive dismissal through breach of contract & take the company to court, best to get advice first. An employer can't just make you redundant, there are certain proceedures they must follow, the company must make your position redundant not the person. They must also prove why they chose to make you redundant and yes they do have to put it in writting that they are reducing your hours due to say, lack of work and if they are offering you alternative hours then they are saying your job is still available therefore they can't make you redundant, you could take then for unfair dismissal The system of government you live in supports and allows companies to do this to their employees. So where are you on these type issues? Are you pro union or do you not care because it doesn't involv you at all. ur employers can cut your hours anytime as long as they give u 2 weeks notice.. as for basically sacking you, unless the company has proper proof that they cant afford you anymore u could probably sue them for unfair dismissal, they cant sack u just cuz u cant work weekends.. they have to work around u nowadays.. If you have a full-time contract then they have to honor whatever the contract dictates. |
