Opinions on whether people agree that I have grounds for a lawsuit? |
I was fired 4 years ago from a local racing facility. They fought my unemployment and I won with the DWD saying I was discharged unjustly. I reapplied at the same place last month due to the casino opening there. I sent in a resume online with previous employment which showed Hoosier Park. I filled out an application after they called me for an interview at which time I mentioned and discussed with them my previous employment and included it in the app. I was offered the job of gaming attendant and given drug screen paperwork, a date for orientation, to get my gaming license and for costuming. I passed the drug screen and then spent 8:15am until 5:10pm in orientation. I was told I am being paid $8 hour for that but was called out 20 minutes before the end of orientation and told they had recieved an email from "Bonnie" in HR saying I was ineligible for rehire. They would mail my check. I turned down another position to take this one and can't get it back now. I was fired by a previous d.r. manager who I had issues with. I had left a message to speak her supervisor about the situation and told he would be in between 5 and 6. At a little before 5, I was called to the security office and told I was being sent home because I had cursed and offended a busser. When I tried to ask about the circumstances, what I said, who it was to, etc...., the head of security was very loud and threatened to have me escorted out by security if I did not leave immediately without any other information. I would be contacted about my schedule. After two weeks, I went to pick up my check and was told to turn in my uniform to get it. I said I was fired, they said I quit. Dept of Workforce Development said that I was fired unjustly. Had never been written up or suspended, nothing. Have complete copy of my file at that time. If they had a no rehire policy, they should have realized that I had been employed there 2 weeks before my orientation day. I think you probably do have a case depending on why the termination was determined to be unjust. If you provide more details, i could probably direct you to which agency you should file with or what type of attorney to retain. You can sue, but expect to loose. Companies can legally put a "do not rehire" on your company record, so all they have to say is that it was noticed while completing your paperwork, your time was paid as agreed, blah blah blah. Why you would want to apply to a company that unjustly fired you is beyond me. Sir, no grounds for a lawsuit - no damages either. As they were under no legal obligation to hire you, you have no case. Being unjustly fired doesn't change that. That's pretty rude of them, but I don't think you have grounds for a law suit. |
