Employement/ HR Question?


I gave my current employer notice of my intent of resignation because i found a better paying full time Job. After I gave my notice they explained that they did not want to lose me and promised me a promotion and a transfer. I accepted and turned down the offer of employment from the other company. Well now after I turned down the other company's job offer my current employer said they will not be able to promote me. What would your next move be? I already called the other company to see if they are willing to offer the position to me again and they said that would have to think about it. My company totally used me. I am furious! They needed me because they could find anyone, now that they have found someone else they are not able to give me what i was promised.

There is an exception to at-will employment. It's called:

Promissory estoppel
A doctrine in which a non contractual promise may be made enforceable to avoid an injustice.


Acceptable alternative ways of describing promissory estoppel are:
A doctrine which arises when injustice can be avoided only by enforcement of a non enforceable promise.


Notes on Promissory estoppel:
Promissory estoppel is used where, although there may not otherwise be a enforceable contract, because one party has relied on the promise of the other, it would be unfair not to enforce the agreement.


What is "promissory estoppel" as it relates to at-will employment?

A: One of the exceptions to at will employment is called "promissory estoppel." To show promissory estoppel, an employee must show:
The employer made a clear and unambiguous promise
You relied on the promise
Your reliance was reasonable and foreseeable and
You were injured as a result
The promise of continued employment for an employee must also be for a specific period of time.

These are generalized statements concerning the promissory estoppel exception. Determining whether a particular situation fits the promissory estoppel mold can only be determined by reviewing the specifics of a situation with an employment attorney.

Well, you should gotten your company's promise in writing -- .

You have done what you could with the other company, you need to wait to see what they say.

If they don't re-offer you the job, you have to continue to do your job in a satisfactory manner at your current job, and continue looking for another job.

Your current company has dealt with you in bad faith and cannot be trusted not to do so in the future -- but there is not much you can do about that right now. Chalk it up to experience.

PS Even if you had it in writing, they still could have reneged and you couldn't do much about it.

The stupidity of some people in business never ceases to amaze me. How your current company thinks they can retain you after treating that way is beyond me.

You got played
Promises mean nothing unless they are in writing
Always get deals in writing
We all make mistakes
So don't stress on this
Lesson learned?
Be careful.. they may fire you.
You may be walking on egg shells
I pray the other job calls you
I hate sneaky conniving corporations

you made your choice. you should always do whats best for you. you have no proof they offered you anything. calling that other job back again makes you look flakey.

Lesson learned. Next time, get it in writing.
