Weingarten Rights - Do they still NOT apply to non-union employees?


So I read that in 2000 the NLRB concluded that WR doesn't apply to non-union employees (http://www.gcglaw.com/resources/employme... Does anyone know if this is still current?

I have a colleague who wants me to sit in on her investigatory meeting (upcoming tomorrow) as I've done this in the past at another institution (unionized there, but not here). Is my participation solely at the discretion of her supervisor?

Your Weingarten right is a specifically Union related right - it is the right to have a Union representative sit in on an investigatory interview. If you're not unionized then you don't have a Union representative, and the issue is moot.

Whether a supervisor chooses to allow some random co-worker (Which is all a Union "rep" is at a non-Union facility) to sit in on an investigatory interview is up to him.
